On February 20, the Moscow City Court at a field session in Babushkinsky Court recognized the decision of the Simonovsky District Court to replace blogger Alexei Navalny in the Yves Rocher case with a real one.
“In accordance with Art. 72 of the Criminal Code of the Russian Federation, the term of imprisonment includes the time spent by Navalny in custody and under house arrest, ”says the decision on the complaints of Navalny and his defense to replace the suspended sentence with a real one.
Navalny spent about 12 months under house arrest; he spent another month in a pre-trial detention center. Thus, in fact, he has already served three and a half years.
On February 2, the Simonovsky Court of Moscow replaced Navalny’s suspended sentence with a real one of 3.5 years in a general regime colony in the case of Yves Rocher. The reason was multiple violations of the probationary period. The court upheld the previous decision in the Yves Rocher case, while 1.5 months of house arrest were credited to Navalny in prison.
On February 16, the European Court of Human Rights (ECHR) as an interim measure asked Moscow to immediately release Navalny from custody in accordance with rule 39 of the court’s rules.
The Russian Ministry of Justice ruled out the possibility of releasing the blogger, noting that this would be gross interference in the work of Russian courts. The head of the ministry, Konstantin Chuichenko, called the ECHR demand unprecedented.
