The Ministry of Transport has developed a draft government decree that amends the regulation on the Federal Air Transport Agency and empowers the department to suspend the licenses of aviation personnel for a period of one month to three years without trial. Izvestia got acquainted with the text of the document. Note, for example, in the case of a driver’s license, only a court can suspend its validity.
The proposed rules set out three cases in which the regulator can do this. This is a violation of the rules for the operation of aircraft, which led to an aviation accident, as a result of which serious harm to human health or major damage was caused; performing the functions stipulated by the certificate, but not meeting the requirements of the air legislation of the Russian Federation; violation of federal aviation regulations (FAR) of the use of the airspace of the Russian Federation.
The draft resolution states that the decision on the timing of the suspension of certificates must correspond to the nature and degree of public danger of the violation and the circumstances of its commission. The holder of the certificate, the action of which is suspended, will have to provide it to the Federal Air Transport Agency within three days, it is indicated in the document. To restore the permit, air personnel will need to undergo training according to an approved program, it follows from the draft rules.
A representative of the Ministry of Transport told Izvestia that it is too early to comment on the details of the provisions of the document being developed.
“It is under public discussion, after which it will be sent to the Ministry of Economic Development to assess the regulatory impact. Based on the results of these procedures, the draft resolution can be finalized taking into account the comments and suggestions received, ”he explained.
