Consortia in times of pandemic: more delinquency and deteriorated coexistence

The Covid-19 pandemic turned many of the tens of thousands of consortiums upside down of buildings in the City of Buenos Aires.

There is an exponential increase of the red in the payment of expenses, and deterioration of the conditions of maintenance of the buildings and of the coexistence between neighbors. Too, administrator inaction, many immersed in a nap since March 2020.

“The increase in delinquency in the payment of expenses is notorious. It came from before the pandemic, but in the pandemic it flared up. With falling income the first thing that many people stop paying is the expenses”, Says lawyer Eduardo Awad, specialist in horizontal property.

Consultations with expert lawyers in consortiums also skyrocketed, says Awad, who observes a drop in the tolerance threshold of neighbors, what translates into more fights and arguments for reasons as diverse as hammer blows at dawn, clandestine parties, or improvised mincing in the living room by boys who for months did not go to school and stopped sleeping at night.

In this context, neighbors and lawyers who work on consortium issues raise their finger against one of the most criticized figures in the world of horizontal property: that of the administrators consortia.

“There are administrators who they haven’t called an assembly for two years. And of course, there are also those who they put their hand in the pocket of the neighbors”, Explains Awad, who is critical of the Buenos Aires City Registry of Consortium Administrators being in the orbit of the Consumer Defense area.

“You cannot reduce this relationship between consortium and administrators to a consumer relationship since there is a mandate. It should be in the orbit of the Secretary of Justice”, Said the lawyer.

Associated Press (AP) journalist Mayra Pertossi denounced that an administrator who scammed his consortium in José Bonifacio 1447, Caballito, and who won two trials in the civil and criminal instances, appeared explaining how to manage buildings in an entity called ACAPPH, one of the various associations that bring together administrators, several of them considered in the market as “rubber stamps”.

“Incredible that Mr. Christian Tettamanti, who embezzled a Caballito consortium and lost both civil and criminal lawsuits, gives talks on good conduct by administrators and, worse yet, advise how to manage in times of pandemic on the website of the Secretariat of Citizen Attention and Community Management of the City“says Pertossi.

If the situation in the City of Buenos Aires is critical, the administration of horizontal property in the province of Buenos Aires became no man’s land.

“Law 14,701, which created the Registry of Consortium Administrators in the province of Buenos Aires, was never regulated. There is no way to report”Awad points out.

The resident and consortium of the Hindú Club de Don Torcuato, María José Villamil, says that suffers that impossibility daily, while accumulating suspicions about the administration of the consortium in which he lives.
