The Basmanny Court of Moscow received a protocol on the commission of an administrative offense on June 4, 2021 during the presentation of the award “Prize MUZ TV 20/21. The beginning of the world. ” The reason was the appearance of pop singer Philip Kirkorov and rapper Dava on the red carpet in the company of half-naked men and men in women’s dresses, and “the performers themselves behaved like a couple in love”, which gave the audience a reason to interpret this performance as a “gay wedding”. According to article 6.21 of the Administrative Code the TV channel was threatened with a fine of a million rubles or a suspension of work for up to 90 days. But the department limited itself to a written warning and sent an order to the management of “MUZ-TV” demanding to eliminate the revealed violations. Izvestia got acquainted with a copy of the RKN protocol and talked with lawyers and representatives of show business.

The protocol received by the Basmanny Court was drawn up following the results of an unscheduled inspection. According to the results of the examination, the fact of gay propaganda, prohibited for children, was revealed (non-traditional sexual relations and denial of family values). The precedent for the trial was the “jokes” on the daytime air of Kirkorov, Dava and Nagiyev: the first recording was shown at one in the afternoon, the second at half past four. Roskomnadzor experts considered this a violation of the Federal Law of December 29, 2010 N 436-FZ “On the Protection of Children from Information Harmful to Their Health and Development.”

On the same day, a few hours later, MUZ-TV shows another broadcast noted in the protocol: “Two men drive up in a convertible, there are bouquets of flowers on the hood of the cars, the host introduces them:“ Philip Kirkorov and Dava, ”they get out of the car. Philip Kirkorov, dressed in a white suit, Dava – in black with a bow tie, behind the car are several men with naked torsos and roses in their hands.

Then Nagiyev begins to shout “Bitter”, as the document studied by Izvestia emphasizes, “psychologically focusing the viewer’s attention on the association of the video shown with the wedding, attracting positive attention to men with significant signs of interpersonal relationships, culturally non-traditional in Russia for men among themselves. “

Passions are fueled by Kirkorov, who says that “Love is wonderful, it has no boundaries, mood, gender, everything is in the name of love, and that’s right.”

This phrase, as emphasized in the Roskomnadzor protocol, “implicitly indicates the possibility of same-sex relationships in the presence of a high degree of emotionally positive attitude.”

And now for courage

The press service of MUZ-TV did not respond to Izvestia’s inquiry, and representatives of Philip Kirkorov did not respond to calls either. The opinions of representatives of show business about what happened were divided.

The expert noted that the propaganda of non-traditional relationships could be quite frank stories of people authoritative for adolescents about their sex life.

– To what extent the officials drew the correct conclusion, that is, whether this prohibition has been violated, only the court has to figure out. We fully admit that, in the absence of proper age restrictions for viewing, and the presence of propaganda, the TV channel can be held accountable, – suggested Lyubov Shebanova.

Yevgeny Safronov, editor-in-chief of the InterMedia news agency, agreed with the lawyer, noting that although the propaganda of non-traditional orientation in the institutions of mass culture was prohibited by law in a number of countries, it is not so easy to determine what exactly it is.

As for the MUZ-TV award, the problem was in the age marker 16+, which did not provide for the promotion of non-traditional relationships, which was proven by experts. On the posters of the spectacular event, there was a 6+ marker, but there could be no complaints here – all the controversial moments were recorded outside the auditorium and only got into the video, ” noted Evgeny Safronov.

He suggested that one can expect the TV channel to challenge the conclusions of Roskomnadzor experts.

– An examination of this kind could well prohibit children from watching much more frivolous in the video “There are only girls in jazz” or “Hello, I am your aunt,” says Evgeny Safronov. – However, the channel chose to remain silent.

The expert explained this by the fact that Roskomnadzor limited itself to the lightest punishment – a warning and an order to eliminate the violation, not even a monetary fine was imposed.

The expert recalled that the propaganda of non-traditional orientation in the institutions of mass culture was often prohibited in a number of countries either by law or by an authoritative public document. For example, in 1930s Germany, along with the criminal prosecution of gays, propaganda (“infection by example”) was de facto prohibited. In the United States, in accordance with clause 4 of the Hayes Code, which was not a law, but practically mandatory for the film industry, back in 1927, it was expressly prohibited to “expose (in the plot) sexual perversions”. The code was only repealed in the 1960s, but the struggle for public morality in the United States continues to this day. In particular, we can recall the scandalous Save Our Children movement in the 1970s and 80s – then it even came to a referendum.
