The Senate approved today (4) a bill (PL) that prohibits the discrimination of blood donors based on sexual orientation. The proposal includes a provision with this prohibition in the National Policy on Blood, Components and Blood Products and provides for punishment in case of non-compliance. The rapporteur, senator Humberto Costa (PT-PE), highlighted the legal support of the Federal Supreme Court (STF), which, in 2020, ruled for the unconstitutionality of a 2016 Ministry of Health ordinance. of blood for 12 months men who had had sex with other men.
“Despite the decision of the Federal Supreme Court, these spurious norms call for a firm stance by this National Congress, and such firmness is within the scope of this bill,” stated the rapporteur in his opinion. “The government cannot treat the LGBTQIA+ community as a group made up of people who pose a danger to public health; the right to be solidary cannot be restricted to any group, the right to actively participate in society, the right to be as one is”, he added.
After approval, the author of the project, Fabiano Contarato (Rede-ES), recalled that all donated blood undergoes testing and, therefore, there is no reason to exclude potential donors just because of their sexual orientation.
“Every blood donation undergoes the same rigorous testing rite to ensure infection prevention. There is no second-rate blood, as there must be no second-rate human being. Excluding someone, a priori, from the possibility of donating only for their sexual orientation is another perverse form of exclusion and violation of the LGBTQIA+”, defended the senator.
